Copyright Infringement Policy
With the popular use of peer to peer network file sharing programs such as KaZaA, Morpheous, and Gnutella to name a few, users may knowingly or unknowingly be using the Âé¶¹Ô´´ network to illegally distribute copyrighted material in violation of the Copyright Act, Title 17 United States Code Section 106(3). To address this potential illegal activity, Âé¶¹Ô´´ has implemented a three step process which includes the following:
First Recorded Allegation
- Network connection is immediately deactivated for violation of Digital Millennium Copyright Act.
- Written notification indicating reasons for deactivation of network connection is sent to offending user.
- Offending user must take the necessary steps to assure that they are no longer serving up any copyrighted material from their computer.
- Signed warning notice by offending user must be made to the Office of Student Affairs indicating that the necessary steps have been taken to prevent further distribution of copyrighted material.
- Upon notification from the Office of Student Affairs, Information Technology will reactivate network connection.
- Warning notice is placed in offending users file.
Second Recorded Allegation
- Network connection is immediately deactivated for violation of Digital Millennium Copyright Act.
- Written notification indicating reasons for deactivation of network connection is sent to offending user.
- Offending user must take the necessary steps to assure that they are no longer serving up any copyrighted material from their computer.
- Written notification form offending user must be made to the Office of Student Affairs indicating that the necessary steps have been taken to prevent further distribution of copyrighted material.
- Upon notification from the Office of Student Affairs, Information Technology will reactivate network connection.
- Copy of notification letter is placed in offending users permanent file.
All Subsequent Allegations
- Network connection is immediately deactivated for violation of Digital Millennium Copyright Act.
- Matter will be sent to the Office of Student Affairs for Judicial Council action.
